A practical guide to investigating diligently and effectively
Following the success of the first edition, we present the 2nd Edition of the Advanced Course on Internal Investigations, a practical, rigorous training program focused on real-world application within organizations.
How do we move from mere suspicion to clarifying the facts? And how do we do so while respecting the law and fundamental rights? Knowing how to investigate makes the difference between putting out fires… or inevitably fueling the blaze. In this course, we will show you, step by step, how to carry out an internal investigation that is effective, respectful, and aligned with legal standards and fundamental rights.
Because investigating is not spying: it is about filtering, asking, documenting, and analyzing — in other words, acting with reason.
Diligent execution of investigations stands as an essential pillar to foster a culture of internal reporting, ensure regulatory compliance, ethics, and good governance within organizations. Proper management of the internal reporting channel, lawful and effective collection of evidence, and informed decision-making are key elements in strengthening the effectiveness of the compliance system.
With the aim of offering advanced and practical training, at Fortuny Legal we are pleased to present this 2nd Edition of the Advanced Course on Internal Investigations, designed to provide participants with the practical knowledge needed to confidently address the challenges these processes entail, ensuring their effectiveness, legal soundness, and alignment with the highest standards of due diligence.

The course presentation will be held on Wednesday, December 10 at 4:00 p.m. (online format), where we will share key details of the program. This same session will be repeated on Thursday, January 15 at 4:00 p.m. for those unable to attend the first date.

- ✔️ In-person at the Círculo Ecuestre in Barcelona (all four sessions).
- ✔️ Live streaming (all four sessions). Streaming students, if they wish, have the option to attend the last session of the course in person at the Círculo Ecuestre in Barcelona, where a cocktail-style lunch will be offered.
👉 If you choose the in-person modality but are unable to attend a particular session, you may exceptionally join that session via streaming. The reverse change (from streaming to in-person) is not possible.

- In-person modality: €850 (includes training and materials. All four in-person sessions will be held at the Círculo Ecuestre and include breakfast and coffee break service. In addition, the final session will conclude with a cocktail-style lunch in one of the Círculo Ecuestre’s private rooms, which will take place immediately after the session from 1:30 p.m. to 3:00 p.m. and is designed to encourage networking among participants and the teaching team. Detailed analysis of the applicable regulations on whistleblowing channels and internal investigations, with a special focus on Law 2/2023 of February 20 on the protection of whistleblowers, international best practices, and ISO standards 37002 and 37008 regarding whistleblowing channels and internal investigations, respectively.

Theoretical and practical analysis of the most advanced techniques for obtaining and ensuring the legality of sources of evidence, with special emphasis on interviews, forensic analysis, and evidence gathered by private investigators.
How to Draft the Final Report
Thorough presentation of the investigation report, along with practical tips to ensure its evidentiary strength and usefulness in corporate decision-making.

🎯 What knowledge will you acquire?
Block I: The Legal Framework of Whistleblowing Channels and Internal Investigations. General Aspects
We will begin the course by addressing the regulations on Whistleblowing Channels and Internal Investigations, analyzing both the hard law applicable in the Spanish legal system, as well as best practices or soft law. Special reference will be made to Law 2/2023 of February 20 on the protection of whistleblowers, as well as to ISO standards 37002 and 37008, regarding whistleblowing channels and internal investigations.
Block II: Internal Investigations: The Importance of Triaging. Foundations and Planning of an Investigation
In this second block, taught by professionals from the criminal and labor fields, we will analyze the different stages an internal investigation must go through, with particular emphasis on the stage that often raises the most questions: triaging the whistleblowing report. We will focus on labor aspects, which often raise doubts, such as monitoring communications, adopting precautionary measures, and the evidentiary value of internal investigations in criminal proceedings. Special attention will be given to procedures related to workplace harassment and sexual harassment.
Block III: Procedures to Be Conducted I. Interviews: Techniques for Obtaining Relevant Information
Entering into the procedures to be conducted in an internal investigation, this block will allow participants to acquire the key tips for conducting interviews in the context of internal investigations, as well as for maintaining the confidentiality guarantee intact. Among other issues, we will address: the interview invitation, the qualities of the person conducting the interview, the limits of the duty to inform the affected party, and important aspects to consider regarding the profile of the wrongdoer.
Block IV: Procedures to Be Conducted II. Forensic Evidence: Methods for Analyzing and Assessing Digital Evidence
This block will cover the essential aspects of forensic evidence, highlighting its key role in investigations and in the accreditation of facts. We will analyze its collection in accordance with the regulatory framework, the necessary guarantees for its validity, and its impact on the evaluation of evidence by the courts.
Block V: Procedures to Be Conducted III. Private Investigator Evidence: Scope, Feasibility, and Validity within the Legal Framework
Taught by renowned detectives in the field, this block will cover the key aspects of the private investigator’s role, from the legal requirements to practice to the procedures that ensure the validity of their actions. We will analyze the phases of the assignment, investigation, and conclusion, the scope of professional secrecy, legal limitations in the investigation of public crimes, and the advantages their involvement brings in the evidentiary process.
Block VI: Drafting the Final Report and Adopting Corrective Measures
The penultimate block of the course will allow participants to clarify the main questions regarding the final report phase and the adoption of corrective measures: Do witnesses have the right to be informed? What corrective measures should I apply? Should I submit the final report to the Public Prosecutor’s Office if a crime is proven to have been committed?
Block VII: Resolution of a Practical Case by Participants
As the final phase of the course, a practical case will be posted on the website one week in advance, to be resolved in class in order to apply all the content learned.
